1. Personalized Self-Expression: Users can express themselves through unique, personalized stickers and other creative tools that enhance authentic engagement. In addition to creating their own stickers, users can also suggest new sticker designs to the admin team. All suggested stickers will be reviewed and approved by the Company’s admin team before being made available for public use.
2. Sharing Real-Life Moments: SafarReels enables users to capture and share real-life moments with their community, fostering genuine interactions.
3. Interactive Features: Engage in fun conversational games and activities, including The Traffic Signal for vibe validation and Drive By for voting and earning Miles, SAFARR’s unique social currency.
4. Connecting with Like-Minded Individuals: Use Gears to filter and connect with individuals who share similar interests and values.
5. Missed Connections and Standing Out: Unique tools like ‘Your Ride’ help users reconnect with missed connections, while Overtakes allow users to stand out and engage further with SafarReels.
6. Privacy and Security: SAFARR is committed to user privacy while maintaining a secure and authentic community. We use anonymous IDs to enhance privacy while ensuring a seamless experience. Some data may be shared with trusted third parties for essential services. Verified profiles contribute to a safer and more genuine environment.
7. Rewarding Experiences: SAFARR’s features ensure users find joy, creativity, and meaningful connections, making it a vibrant and rewarding social experience.

By leveraging these tools and features, SAFARR aims to provide a comprehensive platform that celebrates individuality and community spirit, welcoming all members into the thriving Safarrites community.

1. Eligibility Requirements: Our Services are designed primarily for individuals who are 18 years of age or older, as per the Indian Majority Act, 1875. However, individuals below the age of 18 may access and use the SAFARR, provided they have obtained verifiable parental or legal guardian consent and comply with any age-related restrictions or guidelines set forth by the Platform. By accessing or using the SAFARR, you confirm that you either meet the age of majority or, if under 18, have the consent of your parent or legal guardian to enter into a binding agreement and use our Services in accordance with this policy.
2. Accountability: If you are accessing the Services on behalf of a company, organization, or other legal entity, you represent and warrant that you have the authority to bind that entity to this Agreement. All references to "you" and "your" in this document shall apply to both the individual user and the entity.
3. Restrictions: The Services are not intended for use by individuals who:
• Have been previously removed, suspended, or banned from the platform for violating the terms of this Agreement.
• Are prohibited from accessing the Services under applicable laws.
4. Registration and Compliance: Users must complete the registration process by providing accurate and up-to-date information. Users are responsible for complying with all applicable laws, rules, and regulations related to their use of the Services. These include, but are not limited to:
• Digital Personal Data Protection Act, 2023 (DPDP Act) - Users must respect the privacy rights of others and handle personal data responsibly.
• Information Technology (IT) Act, 2000 (and IT Rules, 2021) - Users must comply with intermediary guidelines, cybersecurity standards, and terms of use.
• Indian Penal Code (IPC), 1860 – The following sections of the IPC are crucial to keep in mind; however, this list is not exhaustive, and other provisions may also apply depending on the circumstances:
  • Section 354D: Prohibits cyberstalking and harassment.
  • Section 499 & 500: Prohibit defamation through false and damaging statements.
  • Section 509: Penalizes acts intended to insult the modesty of a woman, including online misconduct.
  • Section 292: Penalizes the distribution of obscene content. Additional provisions under the IPC and other relevant laws may also be applicable in specific cases.
• Protection of Children from Sexual Offences (POCSO) Act, 2012 - Users are prohibited from sharing, receiving, or soliciting explicit material involving minors.
• Consumer Protection Act, 2019 - Users must ensure that their actions do not involve deceptive practices, misrepresentation, or financial exploitation of others.
• Intellectual Property Laws - Users must respect intellectual property rights, including.
  • Copyright Act, 1957 – Prohibits unauthorized reproduction, distribution, or use of copyrighted content.
  • Trade Marks Act, 1999 – Restricts unauthorized use of registered trademarks, trade names, or brand elements.
  • Patents Act, 1970 – Protects inventions from infringement and unauthorized use.
  • Designs Act, 2000 – Prevents unauthorized reproduction of registered industrial designs.
• Failure to comply with these laws may result in legal consequences, account suspension, or termination of access to the Services.
5. Jurisdictional Limitations: While the Services are primarily designed for users in India, individuals outside India may access the platform if they meet all registration and verification requirements, including the use of an Indian mobile number for OTP-based authentication.

1. Acceptable Use: By using our Services, you agree to:
• Use the Services solely for personal, lawful purposes and in accordance with this Agreement.
• Respect the intellectual property rights of the Company, as well as those of other users and individuals who are not yet using the app.
• Refrain from engaging in any activity that disrupts or interferes with the functionality or performance of the Services.
2. Prohibited Conduct: You must not:
• Violate or infringe upon the intellectual property rights of others.
• Use the Services to post, share, or disseminate content that is illegal, offensive, defamatory, or otherwise objectionable.
• Impersonate others, misrepresent your identity, or provide false information.
• Attempt to gain unauthorized access to the Services or other users' accounts.
• Use automated scripts, bots, or other unauthorized tools to access, modify, or monitor the Services.
• Engage in activities that harm the reputation and integrity of SAFARR or its users.
3. Compliance with Guidelines: You agree to adhere to any additional guidelines or rules provided by us for specific features or functionalities of the Services. Failure to comply may result in suspension or termination of your account.
4. User Responsibilities: As a user of SAFARR, you are responsible for:
• Ensuring that all content you create, upload, or share complies with applicable laws and this Agreement.
• Keeping your account credentials secure and promptly reporting any unauthorized access or breaches.
• Regularly reviewing updates to this Agreement and related policies to stay informed about any changes.
• Stickers created by users are solely their responsibility and are not associated with, endorsed by, or representative of the app platform in any way.
• Communicate respectfully and refrain from harassing, bullying, or discriminating against others.
• Seek consent before sharing or using other users' content for personal or non-commercial purposes.
• Report any abusive, harmful, or unlawful behavior observed on the platform through the appropriate channels.
5. Use of Services for Research and Development: By using our Services, you acknowledge and consent to our collection and use of data for the purpose of improving, developing, and enhancing the SAFARR, as well as contributing to broader research initiatives aimed at community well-being.

As a user of the SAFARR, you agree to the following responsibilities:

1. Compliance with Laws: You shall use the SAFARR in strict adherence to all applicable laws, regulations as mentioned above and the legal requirements in the jurisdictions where you access or utilize the SAFARR.
2. Accuracy of Information: You agree to provide complete, accurate, and truthful information when registering for an account or otherwise interacting with the SAFARR. You further commit to updating your information as necessary to maintain its accuracy and relevance.
3. Prohibited Conduct: You shall not engage in any activities that misuse the SAFARR, including but not limited to:
• Employing SAFARR for unauthorized or unlawful purposes.
• Performing any actions intended to harm, disrupt, or compromise the integrity, functionality, or security of SAFARR, its users, or its systems.
• Transmitting, sharing, or uploading content that is malicious, defamatory, fraudulent, or otherwise detrimental to the rights and interests of others.

By adhering to these obligations, you contribute to a secure, lawful, and positive experience for all users of SAFARR.

1. The User agrees and undertakes not to reverse engineer, modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, software, products, or services obtained from the Website. Limited reproduction and copying of the Website's content is allowed, provided that SAFARR is credited as the source. For clarity, it is explicitly stated that unauthorized mass reproduction, copying, or modification of the content, whether for commercial or non-commercial purposes, is strictly prohibited.

2. The User further agrees to refrain from using the Website’s content in any manner that could damage, disable, overburden, or impair the operation of the Website, or interfere with any other party’s use of the Website.

3. Commercial Use - Users are permitted to utilize the SAFARR for their commercial benefit, including but not limited to promotional activities, marketing efforts, and brand enhancement, provided that such use complies with the terms of this Agreement and all applicable laws. Users are solely responsible for ensuring that their commercial activities on the platform do not infringe upon the rights of others or violate community standards.

1. Commitment to User Safety: SAFARR is committed to providing a secure and safe environment for all users. We implement robust safety measures to protect user data, ensure respectful interactions, and prevent misuse of our platform.
2. User Conduct: To maintain a safe environment, users are required to:
• Treat all users with respect and dignity, refraining from abusive, harassing, or harmful behavior.
• Avoid sharing explicit, violent, or otherwise inappropriate content.
• Report any suspicious or harmful activities or content encountered on the platform.
3. Moderation and Monitoring: While we are not obligated to monitor all content, we reserve the right to review and remove any content or accounts that violate this Agreement or pose a safety risk to the community.
4. Reporting Mechanisms: SAFARR provides tools for reporting inappropriate content or behavior. Users are encouraged to utilize these tools to help maintain a secure environment.
5. Data Security: We employ advanced security measures to protect user data from unauthorized access, breaches, and misuse. For more details, refer to our Privacy Policy.
6. Parental Guidance: Parents and guardians are encouraged to educate minors about online safety and supervise their digital activities to prevent unauthorized access.
7. Limitations: While we strive to create a safe platform, we cannot guarantee complete immunity from harmful activities or interactions. Users are advised to exercise caution and report any issues immediately.

3. Account Integrity: Users must:
• Provide accurate and truthful information during registration and profile updates.
• Safeguard account credentials to prevent unauthorized access.
• Promptly report any account misuse or suspected security breaches.
4. Interaction Standards: Users are expected to:
• Avoid harassing, bullying, or discriminating against others.
• Obtain necessary permissions before sharing third-party content.
• Report harmful or inappropriate behavior observed on the platform.
5. Compliance and Accountability: Users acknowledge their responsibility to adhere to this Agreement and all applicable regulations. Failure to comply may result in account suspension, termination, or legal action where warranted.

1. License to User Content: By uploading, posting, or sharing content on the SAFARR platform, you grant us a worldwide, royalty-free, sublicensable, and transferable license to:
• Host, store, and reproduce your content.
• Display and distribute your content for the operation and improvement of our Services.
• Modify, adapt, and create derivative works based on your content for promotional and functional purposes.
2. Use of Likeness: By using the platform, you grant us permission to use your name, likeness, and profile information in connection with your content for marketing and promotional activities.
3. Analytics and Research: You grant us the right to use anonymized and aggregated data derived from your interactions with the platform to analyze trends, improve our Services, and develop new features.
4. Device Permissions: By accessing the Services, you grant us permission to:
• Access your device’s storage for uploading and managing content.
• Use your device’s camera to capture photos and videos for in-app features.
• Access your microphone for voice-based functinalities.
• Retrieve and utilize your location to provide personlized features and services.
• Access your photos and images to enhance user experience and content sharing.
• Send you notifications and updates related to the services.
• You can manage these permissions through your device settings at any time.
5. Third-Party Sharing: Where necessary for operational purposes, you grant us the right to share your information with trusted third-party partners, subject to our Privacy Policy.
6. Revocation of Permissions: Users may revoke certain permissions via device settings or by contacting support. However, doing so may limit or disable certain features of the Services.

1. Acceptance of Terms: By installing, copying, or otherwise using the Software, the Users agree to be bound by the terms of this Agreement. The Users acknowledge that certain features of the Software may require an active Internet connection.
2. Unauthorized Use and Penalty/Consequences: If a User utilizes the Software, including any related documentation, on behalf of another individual or legal entity without proper authorization, Elemenopee Technologies Pvt. Ltd. reserves the right to impose penalties, which may include, but are not limited to:
• Immediate suspension or permanent termination of the User’s access to the Software.
• Legal action for breach of terms, including claims for damages and injunctive relief.
• Financial penalties equivalent to the losses incurred by the Company due to the unauthorized use.
• Recovery of legal costs and damages resulting from unauthorized access or misuse.
• The Company retains the discretion to determine the appropriate penalty based on the severity of the violation.
3. Data Backup Responsibility: The User is solely responsible for maintaining backups of all data, configurations, and settings stored in the Software. The Company assumes no liability for any loss of data.

1. Ongoing Development: The Company will use its best efforts to ensure continuous development of the Software, including fixing errors and making changes to maintain compatibility with new versions of third-party software.
2. Subscription Fees: For subscription fees, update fees are included in the subscription. The User will have access to all relevant updates during the subscription term.
3. Update Compatibility: The Company does not guarantee that updates will be compatible with the User’s hardware, add-ons, third-party software, or custom configurations. It is the User’s responsibility to test and validate updates in a controlled environment before deploying them on their production system. The Company shall not be liable for any disruptions, data loss, or system issues arising from the installation of updates.

1. Dependency on Cloud Platforms: Certain features of the Software rely on integration with cloud computing platforms to enhance performance, scalability, and security. These platforms offer a wide range of capabilities, including but not limited to:
• Amazon Web Services (AWS) provides hosting infrastructure, scalable computing power, secure storage, serverless computing, content delivery, access control, AI/ML services, and data analytics.
• MongoDB – Offers flexible and scalable database management, real-time analytics, automatic sharding, full-text search, and distributed data processing.
• Redis – Enables high-speed in-memory data processing, caching for improved performance, real-time data streaming, session management, and message brokering for distributed systems.
• Additionally, the Software is distributed and updated through third-party app stores such as Google Play Store and Apple App Store. The Company disclaims any liability for downtime, service interruptions, or disruptions caused by these platforms, including but not limited to outages, maintenance, technical issues, or any other factors beyond the Company’s control.

2. Fair Usage Policy

• Users are expected to use these services for their intended purposes within the bounds of normal activity. Users must not consume disproportionate amounts of cloud resources (such as storage, bandwidth, or processing power) beyond reasonable or normal usage patterns.
• Users must refrain from any activity that could disrupt or harm the cloud infrastructure or the experience of other users, including the spread of malware, unauthorized access, or intentional service disruptions.
• Any activity that violates the terms of service, community guidelines, or applicable laws, including copyright infringement, unauthorized sharing, or illegal data usage, is prohibited.
• Failure to comply with this Fair Use Policy may result in temporary or permanent suspension of your account or access to services.

1. Ownership: The User does not obtain any ownership rights to the Software. Elemenopee Technologies Pvt. Ltd. retains all intellectual property rights, titles, and interests in the Software, including updates, documentation, and all associated data. This includes, but is not limited to, copyrights, trademarks, and other proprietary rights.
2. Restrictions on Use: The User is strictly prohibited from publishing, distributing, or sharing the Software or any related documentation without the explicit, written consent of the Company.
3. Prohibited Acts: The User may not reverse-engineer, decompile, or disassemble the Software unless explicitly allowed by mandatory statutory provisions. In such cases, the User must notify the Company in writing before performing any such actions.
4. Consequences: Any infringement of the Company’s intellectual property rights will result in the immediate termination of this Agreement for cause. The Company also reserves the right to take legal action to seek remedies, including injunctive relief, compensation for damages, and recovery of legal costs incurred due to the infringement. The Company can pursue financial compensation for any losses or damages suffered as a result of the infringement, including reputational harm.

1. User Indemnity: By using the SAFARR platform, you agree to indemnify, defend, and hold harmless Elemenopee Technologies Pvt Ltd, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to:
• Your use or misuse of the Services.
• Your violation of this Agreement, applicable laws, or the rights of any third party.
• Your User Content, including any claims that it infringes, violates, or misappropriates the intellectual property, privacy, or other rights of any third party.
2. Cooperation: You agree to cooperate as fully as reasonably required in the defense of any claim. We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you, and you agree not to settle any such matter without our prior written consent.
3. Limitations: This indemnification obligation will survive the termination of your account and your use of the Services.

1. Company's Liability

• No Warranties: The Services are provided "as is" and "as available" without any warranties or representations, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted availability. Elemenopee Technologies Pvt. Ltd. does not guarantee that the Services will be free of errors, bugs, or interruptions, nor does it assume responsibility for the accuracy, completeness, or reliability of any content provided through the Platform.
• Content Moderation and Liability: The Company is responsible for moderating user-generated content to ensure compliance with applicable laws, including preventing hate speech, pornography, defamation, or illegal activities. In India, under Section 79 of the IT Act, intermediaries (like socializing apps) are not liable for user-generated content if they act as intermediaries and comply with due diligence requirements, such as removing objectionable content upon notice.
• Exclusion of Damages: To the maximum extent permitted by applicable law, Elemenopee Technologies Pvt. Ltd and its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages, including but not limited to loss of profits, data, goodwill, or other intangible losses arising out of or in connection with:
  • Your use or inability to use the Services.
  • Any unauthorized access to or alteration of your transmissions or data.
  • Any conduct or content of any third party on the Services.
  • Any errors, bugs, or interruptions in the Services.
• Limitation on Liability: In no event shall the total liability of Elemenopee Technologies Pvt Ltd exceed the amount paid by you for the Services during the lifetime preceding the date of the claim.
• Jurisdictional Exclusions: Some jurisdictions do not allow the exclusion or limitation of certain damages. In such cases, the limitations above shall apply to the greatest extent permissible under applicable law.
• Risk Assumption: You acknowledge and agree that your use of the Services is at your sole risk. SAFARR disclaims all responsibility for the actions or omissions of other users.

2. User's Liability

• Compliance with Terms: Users are responsible for using the Platform and Services in compliance with all applicable laws as mentioned above in this Agreement, and community standards. Any violation of these terms, including the misuse of the Platform or infringement of intellectual property rights, will result in user liability for all associated damages or losses incurred by Elemenopee Technologies Pvt. Ltd. or third parties.
• Assumption of Risk: Users acknowledge and agree that they use the Platform and Services at their sole risk. Users are responsible for safeguarding their account credentials, data, and interactions on the Platform. Elemenopee Technologies Pvt. Ltd. disclaims liability for the actions, omissions, or misconduct of other users.
• Jurisdictional Exclusions: Some jurisdictions do not allow the exclusion or limitation of certain types of damages or liabilities. In such cases, the exclusions and limitations outlined in this clause shall apply to the maximum extent permissible under applicable law.

1. Representation and Warranty: The Company represents and warrants that it holds the necessary rights, titles, and licenses to provide the Software, including documentation, to the User, and that the Software does not infringe any third-party rights enforceable in India.
2. Exclusions: The above warranties do not cover:
• Infringements or misappropriations resulting from modifications to the Software or documentation by the User.
• The User’s use of the Software with devices, data, or third-party software provided by the User.
• Embedding fonts or other third-party intellectual properties using the Software. The User is solely responsible for ensuring they have the necessary rights for such use.
3. Third-Party Claims: If a third party asserts a claim against the User alleging that the Software infringes their rights:
• The User shall be solely responsible for addressing and resolving the claim at their own expense.
• The Company shall not be liable for any costs, damages, or legal consequences arising from such claims.
• The Company reserves the right, at its sole discretion, to participate in the defense of the claim but shall have no obligation to do so.
• The User agrees to indemnify and hold the Company harmless against any losses, liabilities, or expenses incurred due to the claim.
• The User acknowledges that they use the Software at their own risk and must ensure compliance with all applicable laws and third-party rights.
4. Exclusions: The Company shall not be liable for any claims or damages arising from:
• Unauthorized Use of the Software by the User that is not in compliance with the terms of this Agreement.
• Claims resulting from modifications to the Software made by the User or third parties without the Company’s authorization.
• Infringement claims arising from the Software’s integration, combination, or use with third-party systems, products, or services not provided or approved by the Company.
• The User’s continued use of the Software after receiving notice of a potential infringement claim, if such use is not authorized by the Company.
• Alleged infringement due to third-party content, plugins, or applications accessed or integrated through the Software.
5. Reporting Infringements: If the User becomes aware of any actual or potential infringement of the Software, he must promptly notify the Company in writing.

2. Submission of Complaints: Users may submit their grievances in writing via email or by contacting the Grievance Officer using the provided contact details. All grievances must first be addressed to the Company's admin team for resolution. If the grievance is not satisfactorily resolved by the admin team within a reasonable timeframe as mentioned below, the User may escalate the matter, including pursuing legal remedies through the appropriate courts. Please include the following details for efficient resolution:
• Your full name and contact information.
• A clear description of the grievance or issue.
• Relevant screenshots or supporting documents, if applicable.
3. Response Time: Upon receipt of your complaint, we will acknowledge it within 48 hours. We aim to resolve all grievances within 30 business days from the date of receipt, depending on the complexity of the issue.
4. Escalation: If you are unsatisfied with the resolution provided, you may escalate the matter by responding to the communication from the Grievance Officer, who will review your case further.
5. Jurisdiction and Compliance: This mechanism is established in accordance with applicable laws in India, and the resolution of grievances will adhere to relevant legal and regulatory standards.

1. Governing Law: This Agreement and your use of the Services shall be governed by and construed in accordance with the laws of India, without regard to its conflict of laws principles.
2. Dispute Resolution: Any disputes arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts located in Ahmedabad, Gujarat, India.
3. International Users: If you access the Services from outside India, you agree to comply with all applicable local laws and acknowledge that the laws of India will govern your use of the Services.
4. Severability: If any provision of this clause is found to be unenforceable or invalid, the remaining provisions shall remain in full force and effect.
